By accessing or using Mouseprints (the "Service", "we", "our", or "us"), including any associated websites, APIs, analytics tools, or applications provided, you signify that you have read, understood, and agreed to be bound by these Terms of Service ("Terms"), as well as our Privacy Policy. If you do not agree to these Terms, you may not access or use the Service.

2. Eligibility

You must be at least 18 years of age or the legal age of majority in your jurisdiction to register for and use this Service. By using the Service, you represent and warrant that you meet all eligibility requirements outlined in these Terms.

3. Description of Service

Mouseprints provides session replay functionality, user interaction tracking, heatmaps, click analytics, and AI-generated behavioral insights powered by third-party models (e.g., OpenAI). The Service is intended for lawful use by website owners, developers, and product teams to improve user experience and monitor behavior. You are responsible for ensuring the legality of session recording and data processing on your own website.

4. Account Registration

To access certain features, you must register for an account. You agree to provide truthful, complete, and accurate information. You are responsible for maintaining the confidentiality of your login credentials and are fully liable for all activities conducted under your account, whether authorized or not. If you believe your account has been compromised, you must notify us immediately using the contact form.

5. Subscription, Billing, and Renewals

Access to premium features may require a paid subscription. By subscribing, you authorize us or our payment processor (e.g., Stripe) to charge your chosen payment method at the applicable rate on a recurring basis until canceled. Subscription tiers, pricing, and features may change at any time without prior notice. It is your responsibility to review our current pricing and plan descriptions before purchasing. All sales are final, and refunds are issued solely at our discretion.

6. User Responsibilities and Compliance

You are solely responsible for your use of the Service and any data collected through it. You must comply with all applicable laws, regulations, and third-party rights (including but not limited to data protection, privacy, and intellectual property laws). You agree not to use Mouseprints in a manner that infringes upon the rights of others, violates any law, or would cause harm to users or the Service.

You are required to disclose to your website visitors that session data may be recorded. You are also responsible for obtaining any necessary consent under GDPR, CCPA, or other privacy laws relevant to your jurisdiction or your users.

7. Prohibited Conduct

You agree not to use the Service to:

• Engage in illegal or fraudulent activities
• Record users without appropriate consent or disclosure
• Interfere with or disrupt the Service or servers
• Upload malicious code, viruses, or exploits
• Attempt to reverse engineer, copy, or resell Mouseprints
• Access accounts or data not belonging to you
• Use the Service for high-risk or life-critical systems

8. AI-Generated Insights Disclaimer

Mouseprints may provide AI-generated summaries, behavior predictions, or user segmentation insights. These insights are generated by third-party models and are for informational purposes only. We do not guarantee their accuracy, completeness, or suitability for any decision-making process. Use of these AI outputs is entirely at your own risk.

9. Service Availability and Modifications

We reserve the right to modify, suspend, or discontinue the Service (or any part of it) at any time, with or without notice. This includes updates to features, pricing, subscription models, or user access limits. Continued use of the Service after any changes constitutes your acceptance of the modified terms.

10. Termination

We may terminate or suspend your access to the Service at any time, with or without cause or notice, especially in the event of a breach of these Terms. Upon termination, you must cease all use of the Service and delete any content obtained through it. You may terminate your account at any time using the contact form.

11. Intellectual Property

All intellectual property related to Mouseprints, including logos, code, text, trademarks, and software, remains the sole property of the Service or its licensors. No rights are granted to you other than those expressly stated in these Terms.

12. Disclaimers and No Warranty

The Service is provided "as is" and "as available" without warranty of any kind, whether express, implied, or statutory. We make no guarantees regarding uptime, availability, reliability, or accuracy. We disclaim all warranties including merchantability, fitness for a particular purpose, and non-infringement.

13. Limitation of Liability

To the maximum extent permitted by law, Mouseprints and its affiliates shall not be liable for any indirect, incidental, special, punitive, or consequential damages, including loss of profits, data, or business opportunities. Our total liability to you for any claim arising from use of the Service shall not exceed the amount paid by you in the twelve (12) months preceding the claim.

14. Indemnification

You agree to defend, indemnify, and hold harmless Mouseprints, its affiliates, partners, employees, and contractors from any claims, damages, losses, liabilities, and expenses (including legal fees) arising out of or related to: (i) your use or misuse of the Service, (ii) your breach of these Terms, or (iii) any data or content you collect using the Service.

15. Governing Law and Disputes

These Terms are governed by the laws of the State of Maine, United States, without regard to conflict of law principles. Any disputes arising under or related to these Terms shall be resolved in the state or federal courts located in Maine. You waive any objections to jurisdiction or venue in those courts.

16. Severability

If any provision of these Terms is found to be unenforceable, that provision shall be removed or modified to the minimum extent necessary, and the remainder of the Terms shall remain valid and enforceable.

17. Entire Agreement

These Terms, along with our Privacy Policy and any other posted legal notices, constitute the entire agreement between you and Mouseprints. They supersede all prior or contemporaneous communications, understandings, or agreements.
