Terms of Service

1. Acceptance of Terms

By accessing or using Mouseprints (the "Service", "we", "our", or "us"), including any associated websites, APIs, analytics tools, or applications, you signify that you have read, understood, and agree to be bound by these Terms of Service ("Terms") and our Privacy Policy. If you do not agree, you may not access or use the Service.

2. Eligibility

You must be at least 18 years of age, or the legal age of majority in your jurisdiction, to register for and use this Service. By using Mouseprints, you warrant that you meet all eligibility requirements.

3. Description of Service and Legal Compliance

Mouseprints provides session replay, interaction tracking, heatmaps, click analytics, and AI-generated behavioral insights (using third-party models such as OpenAI). The Service is intended for use by website owners, developers, and product teams to improve user experience.

Legal Compliance: You are solely responsible for ensuring that your use of the Service and any tracking, replay, or analysis on your site is lawful. This includes securing all required disclosures and obtaining any legally required consents under applicable privacy laws (e.g., GDPR, CCPA, CPRA). Mouseprints offers an optional cookie/consent banner to assist with compliance, but its use does not guarantee legal adequacy. The legal burden for compliance remains yours.

4. Account Registration

To access certain features, you must register an account and provide truthful, complete information. You are responsible for maintaining the confidentiality of your credentials and are fully liable for all activities under your account. If you believe your account is compromised, notify us immediately via the contact form.

5. Subscription, Billing, and Quotas

Access to premium features may require a paid subscription. By subscribing, you authorize us or our processor (such as Stripe) to charge your payment method at the posted rate on a recurring basis until canceled. Subscription tiers, prices, quotas, and features may change at any time without notice. Review current plans and quotas before purchasing.

All sales are final. We do not offer refunds for unused time, partial months, or unused features. If you downgrade your plan mid-cycle, any unused portion of your subscription may be converted into a prorated credit automatically applied to future invoices. These credits are non-refundable and expire after account cancellation unless otherwise stated.

Refunds or credits may be provided solely at our discretion in exceptional cases, such as extended service outages or billing errors. These exceptions do not alter our general policy.

6. User Responsibilities & Consent

You are fully responsible for all data collected or processed using the Service. You must:

  • Comply with all data protection, privacy, and intellectual property laws in all applicable jurisdictions.
  • Disclose your use of session recording or tracking to users and obtain/document any required consent prior to data collection.
  • Honor browser “Do Not Track” signals and privacy settings where required by law or platform policy.

Mouseprints offers tools (such as a consent banner), but final compliance is your responsibility. Mouseprints is not liable for your failure to meet legal or platform-specific consent requirements.

7. Prohibited Use

You agree not to use Mouseprints to:

  • Violate any law or regulation, including data privacy laws or third-party data rights.
  • Record users without appropriate consent or disclosure.
  • Collect sensitive or regulated data (e.g., health, financial, biometric, or data from minors under 13) unless lawfully permitted and fully compliant with applicable laws.
  • Interfere with or disrupt the Service or its infrastructure.
  • Upload malicious code or attempt to gain unauthorized access to the Service.
  • Reverse engineer, duplicate, or resell any part of the Service.
  • Access accounts, data, or recordings not belonging to you.
  • Use the Service in critical systems or life-support environments.

Violating these terms may result in immediate account termination and deletion of all associated data, at our sole discretion.

8. Data Storage, Security, and Export

All session data is transmitted via HTTPS and encrypted at rest by our hosting provider (see provider details). Mouseprints does not apply additional encryption beyond the infrastructure provider's controls.

You may export or delete your data using available tools. Exports are provided in standard formats (JSON, CSV). You are responsible for safeguarding exported data from unauthorized access.

9. Data Deletion & Termination

You may pause data collection at any time by removing the tracking script. You may delete sessions and recordings from your account at any time. Account termination initiates data deletion within 30 days in accordance with our retention policies.

If you re-register within 7 days of deletion, session data may still be recoverable. After this period, deletion is permanent and unrecoverable. Data subject requests must be submitted via the contact form. Unless required by law, we do not issue certificates of deletion.

10. AI Insights and Third Parties

Mouseprints uses OpenAI to generate behavioral insights. Only session data necessary for analysis is shared, and never for model training or storage. No other AI vendors are used at this time.

  • AI results are for informational purposes only and may be inaccurate.
  • Do not rely on AI outputs for legal, compliance, or mission-critical decisions.
  • Mouseprints is not responsible for actions taken based on AI-generated summaries or predictions.

11. Quotas and Overages

Access and storage limits are defined by your plan’s quotas. Exceeding quotas may limit access to recordings or analytics. You are notified via in-app banners or usage alerts when nearing or exceeding limits.

12. Service Modifications & Availability

We may change, suspend, or discontinue any feature of the Service at any time, with or without notice. While we aim to notify users of major changes, we are not obligated to do so. Continued use after changes indicates acceptance of revised Terms.

13. Disclaimers, No Warranties, and No Guarantee

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." WE DISCLAIM ALL WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, AND AVAILABILITY. NO GUARANTEES ARE MADE REGARDING UPTIME, PERFORMANCE, OR RESULTS.

14. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, MOUSEPRINTS AND ITS AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING LOSS OF DATA, PROFITS, OR BUSINESS INTERRUPTION. TOTAL LIABILITY IS LIMITED TO THE AMOUNT PAID BY YOU FOR THE SERVICE IN THE PAST 12 MONTHS.

15. Indemnification

You agree to indemnify and hold harmless Mouseprints, its staff, partners, and contractors from any claims, liabilities, or damages arising from your use of the Service, violation of these Terms, or unlawful handling of collected data.

16. Governing Law and Disputes

These Terms are governed by the laws of the State of Delaware, USA. All disputes shall be exclusively resolved in the state or federal courts of Delaware. You consent to personal jurisdiction and venue in those courts.

17. Severability

If any provision is found unenforceable, the remaining terms will continue in full force. Any invalid clause will be replaced by a valid one that most closely reflects the intent.

18. International Users

Mouseprints is based in the United States and governed by U.S. law. If you access the Service from outside the U.S., you are responsible for ensuring your use complies with local laws and regulations.

19. Entire Agreement

These Terms, together with our Privacy Policy and any legal notices, represent the complete agreement between you and Mouseprints regarding use of the Service.
